GitMason Creator Partnership Agreement

This Creator Partnership Agreement (“Agreement”) is between GitMason Inc., a Delaware corporation (“GitMason”), and the creator signing below (“Creator”).

Welcome to GitMason!

We built GitMason to make it easy for creators to earn money from content without having to spend their time managing another platform. You create the content; with your permission, we can handle the posting, fan communication, and selling for you.

We want this relationship to be simple, transparent, and comfortable for everyone. This Agreement explains what you are allowing GitMason to do, what you remain in control of, and how we will work together.

1. You Own Your Content

You keep ownership of all photos, videos, messages, and other content you provide to GitMason (“Content”).

You are giving GitMason permission to use that Content only as necessary to operate your GitMason account, display and sell your Content to users on GitMason, and provide the services described in this Agreement.

GITMASON WILL NEVER SELL, POST, PUBLISH, LICENSE, DISTRIBUTE, PROMOTE, OR OTHERWISE USE CONTENT YOU PROVIDE OUTSIDE OF THE GITMASON PLATFORM WITHOUT YOUR PRIOR WRITTEN PERMISSION.

We want this to be completely clear: giving us Content for your GitMason account does not give us permission to post it on Instagram, TikTok, X, another website or platform, sell it somewhere else, license it to another company, or otherwise distribute it outside GitMason unless you specifically approve that use in writing beforehand.

2. How GitMason Helps You

You authorize GitMason and members of our team to help manage your GitMason account.

Depending on what you are comfortable with, this may include:

• Creating and setting up your account;
• Uploading Content you provide to us;
• Writing captions and descriptions;
• Organizing and pricing Content;
• Offering Content for sale;
• Running promotions or making offers;
• Responding to messages from fans;
• Recommending additional Content that fans may be interested in purchasing; and
• Handling other day-to-day activities necessary to manage and monetize your GitMason account.

You authorize us to perform these activities as your account manager and authorized representative.

You can tell us at any time that there are activities you don’t want us performing on your behalf.

3. Fan Messages

Part of our service may include helping manage conversations with fans so that you don’t have to spend hours responding to messages yourself.

You authorize members of the GitMason team to communicate through your account on your behalf, including responding to fans, discussing available Content, making offers, and facilitating sales.

GitMason will not make promises about you that you haven’t authorized, agree to in-person meetings on your behalf, provide private information about you, or agree that you will create Content outside the boundaries you’ve established.

You can also give us specific instructions about topics, requests, or conversations that are off-limits.

GitMason may inform users through its Terms of Service or elsewhere on the platform that creator accounts may be assisted or managed by authorized representatives.

4. You Set Your Boundaries

You are always in control of what Content you create.

You are never required to create or provide any particular type of Content, custom Content, or anything else you’re uncomfortable making.

If a fan requests something you don’t want to do, you can simply say no—or tell us that category of request is off-limits and we’ll handle it for you.

GitMason will never sell Content that you have not provided or approved for sale.

5. Your Name and Profile

You give GitMason permission to use your name, approved photos, likeness, profile information, and biography as necessary to create, operate, and promote your presence within GitMason.

Any use of your name, image, likeness, or Content outside GitMason requires your prior written permission.

6. Your Content and Eligibility

By joining GitMason, you confirm that:

• You are at least 18 years old;
• The Content you provide belongs to you or you otherwise have the right to provide and sell it;
• Providing the Content to GitMason doesn’t violate another agreement or anyone else’s rights; and
• You will not provide illegal Content.

7. Account Access

You authorize GitMason and its authorized team members to access information necessary to operate and manage your GitMason account and provide the services described in this Agreement.

8. Ending the Partnership

We want creators to stay because GitMason is valuable to them—not because they’re trapped in a contract.

You may end this Agreement at any time by requesting to do so in writing.

GitMason may also end this Agreement by providing written notice to you.

Once the Agreement ends:

• GitMason will stop posting new Content and communicating through your account;
• Your Content will no longer be offered for new sales through GitMason after the account is closed;
• You will still receive any earnings owed to you;
• GitMason will retain only information we’re legally required or reasonably necessary to retain for things such as accounting, fraud prevention, disputes, and transaction records; and
• GitMason’s permission to use your Content ends except as reasonably necessary to complete purchases already made, handle refunds or disputes, or comply with law.

Ending the Agreement does not change the rights of customers who already lawfully purchased Content through GitMason, subject to GitMason’s Terms of Service.

9. Independent Relationship

You are an independent creator and are not an employee of GitMason.

Nothing in this Agreement requires you to create a certain amount of Content, work particular hours, or participate in any particular request.

10. Protecting Each Other

Both sides agree to act honestly and in good faith.

You are responsible for making sure you have the right to provide the Content you give us. GitMason is responsible for using your Content and operating your account only within the authority you give us under this Agreement.

Neither side will be responsible to the other for indirect or unexpected damages to the extent permitted by law.

11. Legal Basics

This Agreement describes the understanding between you and GitMason regarding the creator management services described above.

Your use of GitMason is also subject to GitMason’s Terms of Service and Privacy Policy, as each may be updated from time to time.

Any amendments or additional permissions concerning use of your Content must be agreed to in writing.

Electronic signatures and electronic acceptance of this Agreement will have the same legal effect as handwritten signatures.

If one part of this Agreement is found unenforceable, the remainder will continue to apply.

12. Questions
